Title VI and Policies Prohibiting
Discrimination and Harassment

The College of Westchester is committed to providing a learning and working environment free from unlawful discrimination and harassment. The College complies with federal, state and local laws governing the prohibition of discrimination and maintains a process for the adjudication of alleged violations of its policies. Title VI prohibits discrimination and harassment on the basis of race, color or national origin. Title IX prohibits discrimination and harassment on the basis of sex, including sexual misconduct. The College of Westchester is committed to providing a learning and working environment free from unlawful discrimination and harassment. Consistent with this commitment, and with all applicable laws, the College of Westchester does not discriminate and prohibits any form of discrimination against any person on the basis of race, color, religion, sex, gender, gender identity or expression, pregnancy, age, national origin, disability, sexual orientation, marital status, status as a victim of domestic violence, creed, genetic predisposition or carrier status, military status, or any other legally protected status. This policy covers all programs, services, policies and procedures of The College of Westchester, including admission to education programs and employment.

Any actions knowingly taken to aid, facilitate or encourage another to engage in prohibited conduct and any actions taken for the purpose of interfering in the investigation of an allegation of prohibited conduct shall constitute a violation of one of both policies. Anyone found to have violated this policy will be subject to disciplinary action as set forth in the procedures linked below. The College is committed to provide those who feel that they have been subjected to conduct in violation of this policy with mechanisms for seeking redress and resources for support. Accordingly, the College of Westchester prohibits retaliation against any person for reporting a violation of this policy or for participating in any investigation or proceedings related to an alleged violation.

Incidents involving discrimination or harassment will be adjudicated through disciplinary grievance procedures outlined in the Student Handbook and the Employee Handbook.

This policy governs the conduct of all College students, faculty, staff and visitors that occurs on campus or in connection with College-sponsored programs. This policy also governs conduct by College of Westchester students, faculty, staff and visitors that creates, contributes to, or continues a hostile work or educational environment for a member or members of the College community.

Protecting and promoting freedom of speech and expression is not only a fundamental constitutional right but also critical to the learning experience at CW. Nothing in this policy shall abridge academic freedom or The College’s educational mission. Prohibitions against discrimination and discriminatory harassment do not extend to actions, statements or written materials that are relevant and appropriately related to course subject matter or academic debate.

However, the First Amendment does not guarantee unrestricted speech at any time or place. Activities or conduct that obstruct or disrupt the college mission, interfere with the free speech of others, or jeopardize the safety or wellbeing of the community may necessitate actions to ensure adherence to laws and university policies.

As per federal and state law, incidents involving sexual harassment or sexual misconduct will be adjudicated through the College’s Title IX Grievance Policy and/or its Policy Prohibiting Sexual Harassment and Sexual Misconduct, detailed in the section titled Title IX Grievance Policy and Policy Prohibiting Sexual Harassment and Sexual Misconduct, and available on CW’s website: https://www.cw.edu/titleix. As always, all students and employees have the right to make a report to college officials regarding incidents of sexual harassment by emailing TitleIX@cw.edu or using the contact information below.

The Title IX Coordinator is responsible for:

  • Coordinating the College of Westchester’s efforts to comply with other federal and state laws governing sexual harassment and misconduct
  • Overseeing the College’s responses to reports of alleged violations of the above
  • Identifying and addressing any relevant patterns or systemic problems

The Title VI Coordinator is responsible for:

  • Coordinating the College of Westchester’s efforts to comply with other federal and state laws governing discrimination and harassment on the basis of race, color or national origin
  • Overseeing the College’s responses to reports of alleged violations of the above
  • Identifying and addressing any relevant patterns or systemic problems

The Deputy Title IX Coordinator and Deputy Title VI Coordinator will oversee compliance with respect to employees and will provide updates to the Title IX Coordinator and Title VI Coordinator.
